Diederik Schrijvershof and Leah Peeters have started preliminary relief proceedings on behalf of the national association of independent psychologists and psychotherapists (LVVP) against the Dutch Healthcare Authority (NZa). The LVVP is taking the NZa to court because the NZa is using a calculation method in its ongoing cost price investigation that is unreasonable, unfair and inaccurate. If the NZa continues with its current approach, the rates for independent practices will be an estimated 7% too low from 2026 onwards. This represents an amount of €20 million per year for all independent practices. For more information about this preliminary relief proceedings, see here.
Maverick Advocaten has been assisting various trade and professional associations (and their members) in the healthcare sector on a daily basis for many years in matters relating to (proceedings in the context of) tariff regulation by the NZa. We provide advice on cost price investigations and/or other data requests carried out by the NZa. Where necessary, legal proceedings are brought against an NZa tariff decision. For example, Maverick Advocaten achieved success for providers of forensic mental healthcare against the NZa Tariff Decision on Mental Healthcare and Forensic Care 2023 and 2024. In addition, Maverick Advocaten successfully litigated against the NZa Tariff Decision on General Practitioner Care 2023. Furthermore, Maverick Advocaten is assisting various general practitioners and Stichting De Bevlogen Huisartsen (Foundation for Enthusiastic General Practitioners) in proceedings before the Trade and Industry Appeals Tribunal against the revised NZa tariff decision for general practitioner care 2023.
Maverick Advocaten has been successfully campaigning and litigating for years to ensure that fair rates are set for numerous healthcare providers. Maverick Advocaten has previously achieved success in (summary) proceedings for healthcare providers in relation to the procurement of, for example: orthopaedic shoes (CZ), orthopaedic shoes (VGZ), primary diagnostics (Star ruling), general practitioner care, acute mental healthcare (here and here), forensic care, youth care, SGLVG care, Wlz care (also in appeal), Wmo care (see also here).
