Martijn van de Hel en Paul Breithaupt assisted a furniture store in an investigation by the Dutch Authority for Consumers and Markets (“ACM”) into a possible breach of consumer rules.
The ACM received signals that the furniture store was charging fees to consumers who made a claim under their warranty. The furniture store subsequently contacted the ACM on its own initiative to reach a solution.
After consultation with the ACM, the furniture store has amended its warranty policy. Among other things, the furniture company committed to compensating consumers who had been charged costs during a specific period because they invoked their right to a warranty.
The ACM has accepted the commitments in a decision on 16 March 2026, and is monitoring compliance.
