Martijn van de Hel has written an article for the December issue of the Franchise & Recht journal on the developments in franchise agreements in competition law. The subjects they addressed included the obligation to furnish facts and the burden of proof regarding non-compete clauses and resale price maintenance. They also addressed in detail the possibilities of restrictions in the online sale of products by the franchisor, in response to the recent remarkable Coty judgment. See also our blog on that subject. Other developments addressed in the article are the future of the Block Exemption Regulation and geo-blocking.
