Diederik Schrijvershof, Annabel Kingma and Leah Peeters successfully litigated on behalf of various orthopaedic shoemakers to obtain realistic rates from a large healthcare insurer. Despite increased costs for orthopaedic shoemakers, the insurer refused to index its multi-year agreement. This is contrary to, among other things, the STAR judgment. In view of the preliminary relief proceedings, the healthcare insurer was forced to amend its healthcare procurement policy for medical devices and the healthcare agreement for foot orthoses. This prompted the orthopaedic shoemakers to withdraw their preliminary relief proceedings.
- Maverick Advocaten has previously been successful in (preliminary relief) proceedings for healthcare providers to achieve realistic rates for the procurement of healthcare, including primary diagnostics (also on appeal, STAR judgment), general practitioner care, acute mental healthcare (also here), forensic care, youth care, SGLVG care, Wlz care (also on appeal) and Wmo care (see also here).
- Maverick Advocaten assists healthcare providers on a daily basis in achieving cost-covering NZa rates or in challenging inadequate (turnover) caps. For example, Maverick successfully litigated before the Trade and Industry Appeals Tribunal (‘CBb’) on behalf of forensic care providers against an NZa rate decision and previously also achieved success before the CBb on behalf of Stichting De Bevlogen Huisartsen + 129 individual general practitioners against the Rate Decision for General Practitioner Care and Multidisciplinary Care 2023.
- Furthermore, Maverick Advocaten represents healthcare providers before the NZa and ACM, among others, against abuses of procurement power by healthcare insurers (see here, here and here) and has been advocating for years for effective enforcement of the healthcare (procurement) obligation by healthcare insurers, see here and here.
