Martijn van de Hel and Mats Reijman successfully assisted oil supplier Klaas de Boer in obtaining a license from the ACM for the acquisition by rival FincoEnergies.
Klaas de Boer and FincoEnergies are both active as suppliers of marine fuels. They supply these fuels in ports to various customers, such as fishermen, towage services, passenger/ferry services and offshore companies.
The intention to enter into the transaction was notified to the ACM on 20 December 2024. On 8 May 2024, the ACM decided that a license was required for the proposed acquisition. This license was applied for on 13 December 2024.
During the second phase investigation, the ACM further investigated competition in the northern ports, where both parties are present and so called “port-bound customers” of gas oil in these ports have few alternatives, according to the ACM. The ACM’s concerns were addressed by the parties in the second phase. On 3 April 2025, the ACM approved the acquisition subject to the condition of FincoEnergies selling several business assets (including the name Klaas de Boer) to GMB Group.
