Diederik Schrijvershof, Leah Peeters and Saskia Stolk assist the Dutch Association for Psychiatry (NVvP) in an appeal procedure before the Dutch Healthcare Authority (NZa). This appeal concerns the Tariff Decision Mental Healthcare and Forensic Care 2026.
Earlier this year, Maverick Advocaten successfully litigated preliminary relief proceedings on behalf of the National Association of Independent Psychologists and Psychotherapists (LVVP) before the civil court regarding a calculation method in its cost price investigation in the Tariff Decision for Mental Health and Forensic Care 2026. The NZa did not appeal this ruling and subsequently adjusted the 2026 tariffs for LVVP members, as can be seen here. Specifically, the NZa based the 2026 tariffs for independent healthcare psychologists, clinical (neuro)psychologists, and psychotherapists on the 2025 tariffs. After indexation, the tariffs for LVVP members will increase by an average of 5.2% compared to 2025.
Unfortunately, the NZa refused to comply with the NVvP’s request, in light of the LVVP ruling, to enter into discussion with the NVvP regarding the 2026 tariffs, despite the same issues concerning the calculation method in this case. This compelled the NVvP to file an official objection to the NZa 2026 Tariffs.
- Maverick Advocaten regularly assists (trade associations of) healthcare providers in securing cost-covering NZa tariffs or challenging insufficient (revenue) ceilings. For example, Maverick successfully litigated before the Trade and Industry Appeals Tribunal (CBb) on behalf of forensic care providers against an NZa tariff decision, and previously achieved success at the CBb on behalf of Stichting De Bevlogen Huisartsen and 129 individual general practitioners against the Tariff Decision for General Practitioner and Multidisciplinary Care 2023, see here.
- Maverick Advocaten has previously won numerous (preliminary relief) cases on behalf of healthcare providers to achieve realistic tariffs in healthcare procurement, including in orthopedic shoe care primary diagnostics (also in appeal, STAR-ruling), general practitioner care, acute mental health care (also here), forensic care, youth care, SGLVG care, long-term care under the Wlz scheme (also in appeal), and social support under the Wmo (see also here).
- Furthermore, Maverick Advocaten represents healthcare providers in cases before the NZa and ACM against abuses of purchasing power by health insurers (see here, here, and here) and has for years advocated for effective enforcement of the statutory (procurement) obligations of health insurers, see here and here.
