Maverick Advocaten assists companies in ACM investigations in healthcare sector

Diederik Schrijvershof and Leah Peeters are assisting a company in an investigation by the Authority for Consumers and Markets ("ACM") into alleged abuse of an economic dominant position in the healthcare sector. Maverick Advocaten is assisting this company in ACM's investigation into possible violations of the Competition Act. ACM announced earlier this year that it was investigating companies in the pharmaceutical sector. Pharmaceutical companies may be charging excessive prices. Healthcare providers might also face unreasonable terms and conditions. For more information on the increasing focus of competition authorities on abuse of power in the pharmaceutical sector, see here and on ACM's exploratory investigation into medical devices see here. For more information on the antitrust review of pay for delay agreements in the pharmaceutical sector, see here. Recently, Cyriel Ruers was interviewed by Global Competition Review (GCR) about the new investigations by the ACM into possible excessive pricing and forced bundling in the pharmaceutical sector.

In late December 2022, ACM announced that it was investigating alleged influence by industry associations on individual healthcare contracts. Diederik Schrijvershof and Leah Peeters successfully assisted a healthcare company as part of this investigation.

Het Financieele Dagblad asked Diederik Schrijvershof to comment on the alleged influence by trade associations on individual healthcare contracts. The full FD article can be read here.
