Maverick Advocaten assists importer during anti-dumping investigation by European Commission

Cyriel Ruers and Bas van Os are assisting an importer of lysine in an investigation by the European Commission into the alleged dumping of lysine originating from China.

The anti-dumping proceedings were initiated after a complaint from METEX, the only producer of lysine in the European Union. METEX claims that lysine is being imported into the EU at dumped prices, causing damage to the European industry. Various interested market parties, including exporters, importers and downstream users, are participating in the investigation.

A company not based in the EU is considered to be dumping a product if it imports products into the EU at prices below the normal value of the product. The normal value of the product is based on the production costs or on the prices on the exporter's domestic market. If the Commission finds that dumping is causing damage to the EU industry, it may impose (provisional) anti-dumping measures, consisting of import duties.
