Maverick Advocaten advises Chinese exporter during anti-dumping investigation by European Commission

Cyriel Ruers and Bas van Os assisted a Chinese exporter of lysine during an investigation into alleged dumping of lysine originating in China by the European Commission (“Commission”).

The anti-dumping proceeding was initiated on 23 May 2024 following a complaint from METEX, the only producer of lysine within the European Union. METEX claimed that lysine is being imported into the EU at dumped prices and that this is causing damage to the European industry. Various interested market parties, including exporters, importers and downstream users, participated in the investigation.

On 10 July 2025, the Commission imposed a definitive anti-dumping duty on imports of lysine from China by means of an Implementing Regulation. During the investigation, the Commission refrained from imposing initially higher duties and no retroactive duties were imposed.

Maverick Advocaten assisted the exporter during the investigation in its contact with the Commission. They also provided strategic advice on the effects of the anti-dumping duties on intercompany pricing and production locations.
