Judith Jansen and Cyriel Ruers successfully represented Ameco in the appeal against the State in a dispute concerning the extension of the inspection time – by the Netherlands Food and Consumer Product Safety Authority (NVWA) – for slaughter activities.
The appeal concerned the question of whether the State could be obliged to extend the NVWA inspection time. As Ameco’s proposals complied with the bespoke agreements made and the relevant collective labour agreement provisions, the Court of Appeal in The Hague ruled that the State is obliged to structurally extend the inspection time at Ameco’s premises by half an hour. To compel the NVWA to fulfil this obligation, the court imposed a penalty payment on the State of up to €50,000.
The ruling addresses a current problem in the sector, as inspection capacity is becoming increasingly scarce, causing significant damage to slaughterhouses. The ruling was also discussed in the trade press.
