Cyriel Ruers successfully assisted Farm Frites in the investigation by the Authority for Consumers and Markets (“ACM”) into compliance with the Unfair Trading Practices Act for the Agricultural and Food Supply Chain (“OHP Act for Agriculture”).
Farm Frites is a French fry producer and purchaser of potatoes from various growers. In November, Farm Frites informed potato growers of a change in the discount system for potatoes with quality deviations, due to the low quality of this year's potato harvest. The intention was to prevent large numbers of unnecessary rejections. This announcement led to reports to LTO Nederland, POC Nederland and the ACM, among others. The ACM then launched an investigation under the Unfair Commercial Practices Act for Agriculture.
In dialogue with the ACM, Farm Frites has agreed to give growers more time and clearer information to agree to the change in the discount system. If growers do not agree to Farm Frites' proposal, the current conditions will continue to apply. The ACM has announced that it will discontinue its investigation into Farm Frites.
