Maverick Advocaten successfully puts an end to ACM investigation in healthcare sector

Diederik Schrijvershof and Leah Peeters have successfully represented a company in the healthcare sector in an investigation by the Netherlands Authority for Consumers and Markets (ACM) into alleged abuse of a dominant position (see also this post). ACM found no convincing evidence during its preliminary investigation of any abuse of a dominant position by the company. ACM has therefore closed its investigation. Maverick Advocaten made it clear to ACM, among other things, that the company in question did not have a dominant position within the meaning of Article 24 of the Mededingingswet (Competition Act) or Article 102 of the Treaty on the Functioning of the EU, and no such dominant position could therefore have been abused.

Maverick Advocaten regularly assists companies in investigations by ACM into alleged abuse of a dominant position. It successfully assisted Funda, for instance, in the process to put an end to an ACM investigation into unreasonable conditions allegedly imposed by Funda for access to Funda (see here).
